These terms govern sales made through capursowine.com to consumers (Italian Legislative Decree 206\/2005 \u2013 Consumer Code). By placing an order the customer confirms having read and accepted them. Alcoholic beverages are sold only to adults<\/strong>: by ordering, the customer declares to be at least 18 years old. Goods can only be delivered to an adult.<\/p>\n

3. Products and prices<\/h4>\n

Prices are in euro and include VAT. Shipping costs are shown separately in the cart before the order is confirmed. Product images are for illustration; the vintage is the one stated on the product page. In the event of an obvious pricing error or of a product no longer available, the Winery will inform the customer and may cancel the order, refunding any amount already paid.<\/p>\n

4. Order and conclusion of the contract<\/h4>\n

The contract is concluded when the order is sent. The customer receives an email confirmation with the order summary and a reference to these terms.<\/p>\n

5. Payment<\/h4>\n

Payment can be made by card through Stripe, charged when the order is placed, or by bank transfer. For bank transfers, the amount must be credited within 3 working days<\/strong> of the order, otherwise the order will be cancelled. Card details are handled directly by Stripe and are never visible to the Winery.<\/p>\n

6. Shipping and delivery<\/h4>\n

We ship throughout Italy, including Sicily and Sardinia, with a courier specialised in wine, using certified packaging. For the smaller islands, abroad and orders over 60 bottles, shipping is quoted on request. Orders are shipped once payment has been received; indicative delivery time is 2\u20135 working days<\/strong> and in any case no more than 30 days. Empty wooden cases and accessories are shipped at the rates shown on the Shipping page.<\/p>\n

7. Checking the delivery and breakages<\/h4>\n

On delivery the customer must check the number of parcels and the condition of the packaging. If the packaging is damaged, wet or tampered with, the customer must accept the goods “with reservation”, writing the complaint on the courier’s delivery note.<\/strong> Breakages not visible from the outside must be reported within 24 hours<\/strong> of delivery to azienda@capursowine.com, with photos of the packaging and of the damaged bottles, keeping the original packaging. Without the reservation on the delivery note (for visible damage) or a report within this time, the Winery cannot claim against the courier. For correctly reported damage the Winery will replace or refund the damaged products. On request, before shipping, the order can be insured against all risks at an additional cost quoted by the Winery.<\/p>\n

8. Right of withdrawal<\/h4>\n

Consumers may withdraw from the contract, without giving any reason, within 14 days of delivery<\/strong>, by sending an explicit statement by email to azienda@capursowine.com (the model form below may be used but is not mandatory). Withdrawal is accepted only under these conditions:<\/p>\n

• products must be returned intact and sealed, with capsule and cork untouched, never opened<\/strong>, properly stored and in their original packaging;<\/li>\n
• products must be returned within 14 days of the withdrawal notice, to the address indicated by the Winery;<\/li>\n
• return costs and risks are borne by the customer<\/strong>, who must pack the bottles appropriately.<\/li><\/ul>\n

  Once the products have been received and checked, the Winery will refund the price and the original shipping costs within 14 days, using the same payment method used for the purchase; the refund may be withheld until the goods have been received. Products returned opened, damaged or not properly stored give no right to a refund, or to a refund reduced in proportion to the loss in value.<\/p>\n

  10. Legal guarantee and faulty products<\/h4>\n

  The legal guarantee of conformity under the Italian Consumer Code applies: the customer is covered for defects appearing within 2 years of delivery<\/strong> and must report them within 2 months of discovery<\/strong>. If a wine is faulty (for example “corked”), the customer must keep the bottle with the remaining wine and the cork<\/strong> and contact the Winery, which, once the defect has been checked, will replace or refund the product. Natural sediment or crystals that may form in aged wines are not a defect.<\/p>\n
